vibes: proprietary software license

1. What this covers

"The Software" is vibes: its source code, its compiled WebAssembly and
JavaScript, its documentation, and the synthetic datasets it generates and
ships.

2. No license except as stated here

The Software is proprietary. Except as section 3 permits, no right is granted
to copy, modify, merge, publish, distribute, sublicense, sell, host, or create
derivative works from any part of it, in source or compiled form, without prior
written permission from the copyright holder.

Access to the source, by any means, grants no right to use it.

3. What you may do

You may use the application as served by the copyright holder at
https://vibes.jesse-anderson.net, through a web browser, for any purpose
including commercial work. This permission is non-exclusive, non-transferable,
and may be withdrawn at any time.

The copies of the Software your browser makes in the ordinary course of that
use are permitted. They grant no other right to those files.

4. Your data and your results

Files you open in the application are processed in your browser and are not
transmitted to the copyright holder. They remain yours.

Results you produce with the application (exported data, images, and analysis
settings) are yours to use without restriction. The copyright holder claims no
right in them.

5. What you may not do

You may not, except where applicable law gives you a right that cannot be
excluded by agreement:

  (a) serve, mirror or re-host the Software, or any part of it, from any other
      address;
  (b) remove, disable or circumvent any measure that restricts where the
      Software runs;
  (c) reverse engineer, decompile or disassemble the Software;
  (d) remove or alter any copyright, attribution or license notice.

6. Components released separately

The copyright holder may release parts of the Software, such as a library
published to a package registry, under separate terms. A part released that way
is governed by the license it is released under, for the version so released.
Such a release does not change the terms that apply to anything else, and
nothing in this file is a promise to make one.

7. Third-party components

The Software includes open-source components used under their own licenses,
listed in THIRD-PARTY-NOTICES.md. Those licenses apply to those components and
are not altered by this file.

8. Data that is not part of the Software

The Case Western Reserve University bearing records in datasets/cwru are not
the copyright holder's work and are not covered by this file. They belong to
their publisher, are held for validation only, and are not distributed with the
application. See docs/datasets.md.

9. No warranty, and not an instrument

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

The Software is not a certified measurement instrument and is not a substitute
for the judgment of a qualified person. A result that reports no fault is not
a statement that a machine is safe to run. Do not rely on it as the sole basis
for any decision affecting safety, or the operation or maintenance of
machinery.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COPYRIGHT HOLDER
BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN CONTRACT, TORT
OR OTHERWISE, ARISING FROM OR IN CONNECTION WITH THE SOFTWARE OR ITS USE.
